Personal data protection

Personal data refers to information collected by Tankler OÜ (hereinafter Tankler) for providing services, identifying individuals, contacting individuals to deliver services, resolving inquiries, or sending promotional content.

Tankler does not process sensitive personal data as defined in Regulation (EU) 2016/679 of the European Parliament and of the Council (in English, General Data Protection Regulation, GDPR, or EU Regulation 2016/679).

Tankler is committed to protecting the personal data and privacy of clients and users. Tankler’s online activities comply with all relevant operations and the applicable European Union and Estonian laws, including Regulation (EU) 2016/679 of the European Parliament and of the Council. Tankler implements all precautionary measures (including administrative, technical, and physical measures) to protect the collected personal data. Access to modify and process the data is granted only to authorized individuals.

Security

All personal data that becomes known during visits to Tankler websites is treated as confidential information.

The following outlines the principles of Tankler’s privacy policy regarding the collection, processing, use, disclosure, transfer, modification, retention, and deletion of personal data.

These principles do not apply to the processing of data from legal entities and other companies/institutions, nor do they cover the processing of personal data on websites/service environments referenced on our websites/service environments (external links).

A person representing a company (as a service subscriber) is not a natural person; they are an authorized representative of a legal entity, whose personal data processing is not regulated by Regulation (EU) 2016/679 of the European Parliament and of the Council.

1. What data is collected?

Personal data processed by Tankler customers and uploaded to the Tankler environment as part of the service is protected by a confidentiality obligation that takes effect when the customer signs the service agreement. Tankler services may only be used after accepting the agreement. Acceptance of the agreement is verified by software, and if acceptance has not been given, the user will be asked to agree to it.

For the purposes of personal data processing listed in this subsection, access to the data is granted to Tankler OÜ employees, who apply all security measures in their work regarding the processing of your data.

Consent for the collection of personal data related to and necessary for the service is given by the subscriber at the time of ordering the service. By placing the service order, consent is considered granted with the corresponding timestamp.

2. How long is the collected data retained?

Anonymized technical data collected from websites and service environments is retained indefinitely.

Personal data associated with identified inquiries and/or transactions is retained for up to 7 years from the last interaction with the service provider, in accordance with the obligation in the Accounting Act to verify transactions. Interactions include, among others, responses to direct marketing through viewing or clicking links.

3. To whom may the collected data be disclosed?

Personal data processed by Tankler may only be disclosed without the individual’s consent to an institution or person who has a direct legal right to access it (for example, a court or pre-trial investigator) and a justified need.

Personal data processed by clients within the Tankler service is treated as confidential, and the right to process, disclose, or transfer such data rests solely with the data owner (the client).

At the request of Agri Partner’s client, Tankler provides technical assistance in data processing, but this does not alter the ownership of the data or the allocation of responsibility.

4. What rights does an individual have regarding their collected data?

The right to access, correct, and stop the processing of your data.

By default, personal data is not disclosed, except when explicit consent has been obtained (for participation in trainings, seminars, or conferences).

If personal data cannot be modified, accessed, or disclosed through the website or service environments, a request for access to or correction of the data should be submitted in a manner that enables identification of the individual. Where possible, the data will be provided or corrected within 7 working days.

If you wish to opt out of direct marketing offers, either entirely or for specific topics, this can be done immediately via the link in the footer of each marketing email. The change takes effect immediately.

If there is no longer a legal basis for processing, disclosing, or providing access to personal data, a request can be made to stop using or delete the data, or to cease its disclosure or access. To do so, a request should be submitted in a manner that enables identification of the individual.

The request will not be granted if:

– An email address cannot be deleted if it is needed to stop sending direct marketing offers. To fulfill the request, the email address must remain available for comparison to ensure no further emails are sent.

– Not all data in the CRM can be deleted if the goal is only to stop further contact. To fulfill the request, enough data must remain for comparison to ensure that no contact is made.

5. How and for what purposes do we use cookies?

We use cookies on our website to make our service more user-friendly and to provide enhanced and customized functionality when visiting the website and viewing our products.

If enabled in the browser settings, the browser will allow only cookies from the website you are currently visiting to be stored. We use session cookies, persistent cookies, and third-party cookies (Google Analytics, Facebook). These analytical cookies allow us to recognize visitors, count them, and track movement on the website. This helps us improve the performance of our website.

7. Marketing

Tankler wishes to provide relevant news about Tankler’s services to its customers who are interested in receiving direct marketing communications.

By subscribing to our newsletter on the website www.tankler.ee, you will receive emails with news about the company’s activities, new blog posts, and upcoming events (such as our organized trainings, as well as special offers from partners for list members) up to 3 times per month. For sending marketing communications via email, we process your name and email address.

When Tankler sends you an email, we may collect statistical data about your interaction with that communication, such as whether you opened the email, which links you clicked, what devices you used, and their technical characteristics. This information is stored in the contact history. We may evaluate the behavior of our contacts before sending the newsletter (data from contact history, participation in organized events, etc.). This is necessary to send you more personalized messages by email. Tankler has a legitimate interest in understanding its contacts’ needs and preferences in order to provide them with more relevant information.

Please note that if you are in our contact database, we may process your name and email address or mobile phone number for the purpose of showing advertisements to you or to people similar to you (so-called Lookalike Audiences) on Facebook, Google, YouTube, LinkedIn, and/or Instagram.
